These Terms of Service ("Terms") govern your access to and use of the FictionAI platform and services (the "Service") operated at https://www.fictionai.pro. By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. Your continued use of the Service constitutes ongoing acceptance of these Terms, including any modifications we may make from time to time.

2. Description of Service

FictionAI is an AI-powered book writing platform that uses third-party artificial intelligence models to generate text content, characters, outlines, world-building elements, and other creative works. The Service is provided "as is" and "as available" without any guarantees regarding quality, accuracy, completeness, or fitness of AI-generated output for any particular purpose.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are solely responsible for all activity that occurs under your account.
  • You agree to provide accurate and complete information when creating your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Use at Your Own Risk

YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK. AI-generated content may contain errors, inaccuracies, inconsistencies, biased language, or content that may be unsuitable for your intended purpose. You are solely responsible for reviewing, editing, and verifying all content generated through the Service before any use, publication, or distribution.

FictionAI makes no representations or warranties that AI-generated content will be original, non-infringing, accurate, complete, or suitable for any commercial or personal purpose.

5. AI-Generated Content

5.1 Ownership

You retain ownership of the original inputs you provide to the Service (such as prompts, outlines, and creative direction). As between you and FictionAI, you own the AI-generated output created through your use of the Service, subject to the rights of any third parties and the limitations of applicable law.

5.2 Your Responsibility

You are solely responsible for any use of AI-generated content, including but not limited to publication, distribution, or commercialization. FictionAI assumes no responsibility or liability for how you use, publish, or distribute content generated through the Service. You are responsible for ensuring that your use of generated content complies with all applicable laws, including intellectual property, defamation, and obscenity laws.

6. No Refunds

ALL SALES ARE FINAL. ALL PAYMENTS, INCLUDING SUBSCRIPTION FEES AND CREDIT PURCHASES, ARE NON-REFUNDABLE. By making a purchase, you acknowledge and agree that you will not be entitled to a refund for any reason, including but not limited to:

  • Dissatisfaction with AI-generated content quality
  • Unused credits or subscription time
  • Service interruptions or downtime
  • Changes to features, pricing, or available AI models
  • Account termination due to violation of these Terms

You may cancel your subscription at any time, but no refund or credit will be issued for the remainder of the billing period.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Service
  • Copy, reproduce, distribute, republish, or create derivative works of the Service, its software, user interface, or underlying technology
  • Resell, sublicense, or provide access to the Service to third parties without authorization
  • Use automated systems, bots, or scripts to access the Service in a manner that exceeds reasonable human usage
  • Interfere with or disrupt the integrity or performance of the Service
  • Circumvent or attempt to circumvent any usage limits, credit systems, or access controls
  • Use the Service to generate content that is illegal, threatening, abusive, harassing, or that promotes violence or discrimination

8. No Reproduction of Software

You may not copy, reproduce, modify, distribute, display, or create derivative works based on the FictionAI platform, its software, code, design, user interface, or any component thereof, in whole or in part, without our prior written consent. This prohibition applies regardless of the medium or format, whether currently known or hereafter developed.

9. Intellectual Property

The Service, including its software, design, logos, trademarks, and all related intellectual property, is owned by FictionAI and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service other than the limited right to use it in accordance with these Terms.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

FictionAI expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components
  • Any warranty regarding the accuracy, reliability, quality, or completeness of any AI-generated content or data
  • Any warranty that the Service will meet your specific requirements or expectations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FICTIONAI, ITS OWNER, OPERATORS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, punitive, or exemplary damages
  • Loss of profits, revenue, data, or business opportunities
  • Cost of procurement of substitute goods or services
  • Damages arising from AI-generated content, including claims of copyright infringement, defamation, or inaccuracy

arising out of or in connection with your use of or inability to use the Service, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if FictionAI has been advised of the possibility of such damages.

IN ANY EVENT, FICTIONAI'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE LESSER OF: (A) THE AMOUNT YOU HAVE PAID TO FICTIONAI IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

12. Indemnification

You agree to defend, indemnify, and hold harmless FictionAI, its owner, operators, affiliates, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including any intellectual property, privacy, or proprietary right
  • Any content you create, publish, or distribute using the Service
  • Any claim by a third party related to AI-generated content you produced through the Service

13. Account Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account data and all associated content
  • No refund or credit will be issued for any unused subscription time or credits
  • Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Indemnification, and Disclaimer of Warranties) will survive

14. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located within the United States, and you consent to the personal jurisdiction of such courts.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FictionAI regarding the Service and supersede all prior agreements and understandings.

18. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
